Uttarakhand Real Estate Laws

Uttarakhand has introduced stricter land-purchase regulations to protect agricultural land and control property acquisitions by people from outside the state. Under the Uttarakhand Land Law Amendment Act, 2025, the rules for residential, agricultural, horticultural and commercial land purchases are different.
Here is a simple explanation of how much property an outsider can buy in Uttarakhand.
Residential Property – Up to 250 Square Metres
A person from another state can purchase up to 250 square metres of residential land without prior government permission under the applicable provision.
However, there are conditions:
- The buyer must submit an affidavit to the Sub-Registrar.
- The buyer or their family must not have previously purchased more than 250 square metres of residential land elsewhere in Uttarakhand during their lifetime.
- Providing a false affidavit can make the property transfer void.
The 2025 amendment excludes municipal corporations, Nagar Palika Parishads, Nagar Panchayats and cantonment areas from its territorial application. Therefore, the exact location must be checked before applying this limit.
Agricultural Land – Strict Restrictions
The new law significantly restricts agricultural land purchases by outsiders.
| Districts | Agricultural land purchase |
|---|---|
| Dehradun | Not permitted for outsiders under the new restrictions |
| Nainital | Not permitted |
| Almora | Not permitted |
| Pauri Garhwal | Not permitted |
| Tehri Garhwal | Not permitted |
| Uttarkashi | Not permitted |
| Chamoli | Not permitted |
| Rudraprayag | Not permitted |
| Pithoragarh | Not permitted |
| Bageshwar | Not permitted |
| Champawat | Not permitted |
| Haridwar | Permitted with prior State Government approval |
| Udham Singh Nagar | Permitted with prior State Government approval |
The restrictions apply to agricultural land outside the specified municipal and cantonment boundaries.
Horticultural Land – Similar Restrictions
Horticultural land includes land used for orchards, fruit cultivation and other horticultural activities.
Under the 2025 amendment:
- Outsiders cannot purchase horticultural land in the 11 restricted districts.
- Purchases are possible in Haridwar and Udham Singh Nagar with prior State Government approval.
- The buyer must submit an affidavit confirming that the land will be used only for the approved agricultural or horticultural purpose.
Commercial and Industrial Property – Up to 12.5 Acres
Commercial and industrial land purchases have separate provisions.
In the 11 restricted districts, the 12.5-acre ceiling applies to relevant approved purposes, including industrial and tourism projects.
Examples include:
- Hotels and resorts.
- Industrial units.
- Educational institutions.
- Hospitals.
- Tourism facilities.
- Other eligible commercial projects.
Purchases require the applicable government sanction and departmental Land Essential Certificate.
In Haridwar and Udham Singh Nagar, the government can permit land transfers beyond the prescribed ceiling for specified purposes after the concerned department assesses the project and issues the required certificate.
